General conditions of sale
- The contracting party is Tradizioni Cilentane sas di D'Angelo Aniello & C., a limited liability company with registered office in Via Belvedere, 84066 Caprioli di Pisciotta (SA) VAT number 03653310650, exclusive owner of the Tradizioni Cilentane trademark and the related website tradizionicilentane.it
- By placing an order on the online store tradizionicilentane.it, the Customer declares that he has read all the information provided to him during the purchase procedure, and that he fully accepts the general and payment conditions transcribed below.
Introduction
The customer who registers or places an order, even without registering, on the tradizionicilentane.it website is required to accept this regulation, to insert or provide his personal data during the order phase, which actually correspond, and to update them if they are no longer true.
Information on the processing of personal data ( Privacy )
The contractor, in accordance with art. 10 of Law 675/96, declares that the data collected through the website tradizionicilentane.it are intended to register the customer and/or manage and process orders from, and activate a commercial information service for them. Such data will be processed electronically or physically in accordance with the laws in force, may be communicated to the technical managers of the services used by the contractor and the website tradizionicilentane.it and used and disseminated exclusively within the scope of the purposes of the service provided. The interested party enjoys the rights pursuant to art. 23 of Law 675/96. The owner and person responsible for the data collected is Aniello D'Angelo, in legal representation of the contractor and at the same address.
Purchase methods
To proceed with the purchase on tradizionicilentane.it the customer must proceed by following the instructions on the same by adding the products to their cart and explicitly confirming their desire to purchase the chosen goods by clicking on the appropriate buttons.
Correct receipt of the order is confirmed by an e-mail notification, sent to the e-mail address provided by the Customer during order registration or registration on the site.
This confirmation message will contain the Date and Order Number, to be used in any further communication with tradizionicilentane.it. The order is not considered confirmed until such e-mail has been received.
It is the Customer's sole responsibility to register with their correct data and to keep such data updated using their login credentials, should they decide to register on the site.
In the event of the impossibility of the contractor to fulfill the order placed by the customer due to unexpected unavailability of the goods or other causes beyond the control of the contractor, the order may be cancelled and any charges will be refunded to the Customer using the same payment method used by the Customer or by bank transfer.
Determination of the Price and Payment Methods
The total price indicated at the conclusion of the order includes shipping costs if due and any packaging costs, in addition to the VAT required for the Italian national market, while it does not include any customs duties and additional taxes on the sale, applied in the event of export of goods abroad.
All additional charges due for customs clearance operations are exclusively borne by the Customer receiving the shipment, who must independently provide for such formalities and payments.
The only official price of the sale to refer to is the one indicated in the last step of the shopping cart, before confirmation and definitive registration of the order. Any price indicated above that may be different from this amount due to technical or other problems cannot be taken as a reference and used as compensation.
All amounts displayed on tradizionicilentane.it are expressed in Euros, as the reference currency.
The payment methods accepted by tradizionicilentane.it are the following:
- Credit Card
The transaction with Credit Card takes place through the electronic system of the BANK Bank Name; at no time during the purchase procedure will the electronic system of the contractor and no operator of the same be able to gain knowledge of the Customer's credit card number, which is provided by the Customer to the Secure Server of the Credit Institute on a protected internet connection with standard SSL encryption with 128-bit symmetric key, according to the current standards of the online payment market. tradizionicilentane.it does not display or store any data relating to the customer's credit cards.
- PayPal
In the case of purchases made with PayPal payment, PayPal will immediately charge the amount relating to the purchase made upon conclusion of the online transaction. In the event that the order is cancelled, the amount relating to the cancelled goods will be credited back to the customer's PayPal account. The times for crediting the amount depend exclusively on PayPal and the banking system. Once the amount has been credited back to the PayPal account, in no case can tradizionicilentane.it be held responsible for any damages, direct or indirect, caused by delays in the actual crediting depending on PayPal or the banking system. At no time during the purchase procedure is tradizionicilentane.it able to know the information relating to the buyer's credit card or other information provided to PayPal. tradizionicilentane.it does not view or store any data relating to the customer's credit cards.
- Bank Transfer
Purchases with bank transfer payment method require the transfer to be made in advance of the order being shipped, no later than 48 hours after the order is placed, with a payment to the bank account indicated at the time of the order and in the order confirmation email.
To process the order, tradizionicilentane.it will wait for the payment to be actually credited to its account, usually within 1 to 3 working days.
No order can be shipped before the expected amount has actually been credited to the tradizionicilentane.it account.
- Cash on delivery Cash
on delivery is accepted exclusively for orders of an amount equal to or less than €500.00, which can only be paid in cash and directly to the courier upon delivery of the goods.
Delivery methods and times
Delivery costs are explicitly highlighted when the order is placed. Some promotions may offer free shipping or discounts equal to the shipping costs for orders over a certain value determined by the offer itself.
The fulfillment by tradizionicilentane.it will occur at the moment of delivery of the goods to the courier, who will arrange for their delivery. tradizionicilentane.it is not responsible for the failure to respect the delivery times by the courier. Errors, delays and losses related to shipment by courier are not attributable to tradizionicilentane.it, but to the courier itself.
The order processing times are approximately 48 hours for the preparation of the order in our warehouses, in the case of goods in stock, and a maximum of 7 working days for delivery by the courier on the national territory, except for islands, disadvantaged geographical areas and causes of force majeure.
Deliveries cannot be made in the municipalities of Livigno and Campione d'Italia.
Tradizionicilentane.it reserves the right to choose at its sole discretion the courier to be used for the delivery of the goods, based on the location and type of goods ordered.
The customer can also choose to collect the goods from our warehouse, choosing the appropriate method during the order phase. Collection from our warehouse may also involve management costs, explicitly specified during the order phase and in the order summary itself.
At the time of shipment, tradizionicilentane.it may make available without any obligation in the user area of the site and/or with notification via e-mail any shipment tracking or information on the delivery date.
Upon delivery of the goods by the courier, the Customer is always required to check:
- that the number of packages delivered corresponds to that indicated in the transport document;
- that the packaging is intact, not damaged, not wet or in any way altered, even in the sealing materials (adhesive tape or heat-sealed straps);
- any damage to the packaging and/or the product or the lack of correspondence in the number of packages or indications must be immediately contested to the courier, accepting the shipment indicating on the courier's proof of delivery the wording: WITH RESERVATION OF INSPECTION;
- Once the material has been accepted without reservation of inspection indicated on the courier's document, the Customer may not make any objection regarding the external characteristics of what has been delivered.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 10 working days of delivery, according to the methods set out in this document.
In the event of failure to collect the material stored in the courier's warehouses within 15 working days due to repeated impossibility of delivery to the address indicated by the Customer at the time of ordering, the order will be automatically cancelled. The relative price will therefore be retained by the contractor; in the event of collection of the goods during the storage period, the Customer will be required to bear any costs relating to the storage itself, paying them independently and directly to the courier who is managing the shipment.
Withdrawal of the seller
Tradizioni Cilentane sas di D'Angelo Aniello & C. will have the right to withdraw from the contract at any time until confirmation by its bank of the crediting of the sale price of the goods.
This confirmation must occur within 30 days of the order date, otherwise the order will automatically be considered null.
Tax Aspects
For VAT purposes, indirect e-commerce transactions are entirely similar to mail order sales and, therefore, are not subject to the obligation to issue an invoice (unless requested by the customer no later than the time the transaction is carried out), as provided for by article 22 of Presidential Decree no. 633 of 1972, nor to the obligation to certify by issuing a receipt or tax receipt pursuant to article 2, letter oo), of Presidential Decree no. 21 December 1996. 696.
tradizionicilentane.it will therefore only issue the invoice if requested by the customer during the order phase, and if the customer has entered all the data necessary for the correct compilation of the same: VAT number and/or tax code, Company name and/or Name and surname and full address.
The invoice will be sent either in paper format inside the package with your order, or in digital pdf format sent by email or made available within the user area of the site.
In the case of a digital invoice, in accordance with the law, it will be the customer's responsibility to print and keep a copy of the document.
For orders for which an invoice is not requested, no document will be issued. Inside the shipment you will only find the order summary and any necessary transport document.
The customer can request the invoice even after receiving the order, but only within the month in which the purchase was made.
RIGHT OF WITHDRAWAL (pursuant to Legislative Decree 206/2005)
Tradizionicilentane.it recognizes, in accordance with the procedures established by current law, the right of withdrawal from your purchase.
Satisfied or refunded: As required by law, the user has the right to withdraw from the purchase within 10 days of receiving the product at their home (the delivery date recorded by the courier is valid).
Methods of the right of withdrawal
To exercise the right of withdrawal it is necessary that:
- the customer must express his/her will to exercise the right of withdrawal by sending an e-mail to info@tradizionicilentane.it or a registered letter with return receipt to Tradizioni Cilentane sas di D'Angelo Aniello & C. in Via Belvedere, 84066 Caprioli di Pisciotta (SA), indicating the order number for which he/she intends to exercise the right of withdrawal.
The customer is not required to give a reason for his/her choice.
- the purchased item must be returned intact and returned in the original packaging without any tampering or damage, with any transport documents, invoices and receipts contained inside attached.
The return shipping costs are entirely borne by the Customer, who can choose the preferred method for the return. The package must be returned no later than 10 days after the request for withdrawal is opened (via email or registered mail).
In the event that the package has been damaged during shipping, the customer, in order to obtain the rights provided for by the legislation on withdrawal, must have accepted the package from the courier with reservation of control, and in any case open a dispute with the courier responsible for the delivery. To withdraw in these cases, it is necessary to contact tradizionicilentane.it via email or telephone and follow the instructions provided. The operator may request photos to document the reported damage.
After the package has been returned to our office and we have verified the integrity of the package and the products contained therein, we will refund the entire amount of the order and the costs incurred for the return by bank transfer or by the payment method used by the customer, within 30 days of receiving the goods at our office.
Products excluded from the right of withdrawal
By law, customized products do not allow you to benefit from the right of withdrawal: therefore everything that has been created exclusively to measure and in any case clearly personalized for a specific Customer and therefore not resalable or reusable, will not be able to benefit from the right of withdrawal in any way and therefore tradizionicilentane.it will not be held to any compensation even if requested by the customer using the methods indicated above (Legislative Decree 206/2005 art55).
Complaints
Any complaints must be made by contacting customer service via email at info@tradizionicilentane.it or at the telephone number indicated on the site, valid only for Italy.
Applicable law and competent court
The sales contract between the Customer and Tradizioni Cilentane sas di D'Angelo Aniello & C. is understood to be concluded in Italy and regulated by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this remote sales contract, the territorial jurisdiction is exclusively that of the Court of Vallo della Lucania.
